Terms of Service

1. Agreement to these Terms

These Terms of Service (“Terms”) govern your access to and use of Tseha (the “Service”), operated by MH Mariusz Henn (“Tseha”, “we”, “us”, or the “Service Provider”). By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Business and professional use only

The Service is intended for business, organizational, and professional use only. By creating an account or purchasing a paid plan, you represent that you are acting on behalf of a business, organization, or professional activity, and not as a consumer. You must be authorized to bind the organization on whose behalf you act.

3. Accounts and organizations

Authentication is provided through third-party identity providers (such as Google and Auth0). You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Organization administrators are responsible for managing members, roles, and permissions within their organization.

4. Acceptable use

You agree not to:

  • upload or process content you do not have the right to use, or that infringes the rights of others;
  • use the Service to create or distribute malware, to circumvent security measures, or for phishing or other unlawful activity;
  • abuse, overload, or attempt to gain unauthorized access to the Service, its API, or its MCP endpoints;
  • exceed the rate limits or plan limits applicable to your subscription.

We may suspend or terminate accounts that violate these Terms, as described in section 9.

5. Customer content and intellectual property

You retain all rights to the standards, components, documentation, and other content you submit to the Service (“Customer Content”). You grant us a limited, non-exclusive license to host, process, and transmit your Customer Content solely to provide and maintain the Service.

We retain all rights to the Service, its software, and its design. The MCP server is read-only and outbound: it serves your standards, components, and design tokens to your agent and has no capability to read, receive, or store your source code. Your source code never flows to Tseha. We do not use your Customer Content to train artificial-intelligence models.

6. Plans, fees, and billing

Paid plans are billed through Stripe. By purchasing a paid plan you authorize us, via Stripe, to charge the fees shown at checkout. Subscriptions renew automatically for successive billing periods unless cancelled before the start of the next period.

Prices are shown exclusive of taxes unless stated otherwise; applicable VAT or other taxes may be added at checkout. Fees are non-refundable except where required by law. If a payment fails, we may suspend or downgrade access until payment is resolved.

7. Free plan and trial

We may offer a free plan and/or a time-limited trial. At the end of a trial, unless you have an active paid subscription, your access may be limited to the free plan or suspended. We may change the features of the free plan at any time.

8. Availability and disclaimer

The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or secure, except where a separate Service Level Agreement is expressly agreed in writing.

9. Limitation of liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, or consequential damages, or for loss of profits, data, or business, arising out of or related to your use of the Service. Our total aggregate liability under these Terms shall not exceed the amounts you paid to us for the Service in the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

10. Suspension and termination

You may stop using the Service at any time and cancel your subscription from your account. We may suspend or terminate access if you breach these Terms, fail to pay, or use the Service in a way that creates risk or legal exposure. On termination, your right to use the Service ends; we will handle your Customer Content in accordance with our Privacy & Cookie Policy.

11. Changes to the Service and these Terms

We may modify the Service or these Terms. If we make material changes, we will provide reasonable notice (for example, by email or in-product notice). Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

12. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Poland. Disputes shall be subject to the jurisdiction of the courts competent for the seat of the Service Provider, without prejudice to any mandatory consumer-protection rules that may apply.
